Probate
Probate is a document which is issued by the Probate Registry of the Supreme Court of South Australia.
When a person dies, the executor of a Will may be required to make an application for Probate if the deceased person’s assets are such that Probate is needed to access the assets. We can assist in preparing the application for Probate which comprises an oath and an affidavit exhibiting a statement of assets and liabilities as at the date of death.
Upon the Court being satisfied about all matters contained in the application, it will issue Probate. The Probate document may then be produced to financial institutions and Government departments (such as the Lands Titles Office) to enable the assets in the sole name of the deceased to be dealt with by the executor. The executor may sell or transfer those assets.
