Intestacy


A person who dies without leaving a Will is described as dying “intestate”.  In that event, the Administration and Probate Act sets out the manner in which the Estate will be distributed.

The Rules under the Administration and Probate Act set out who is entitled to administer the Estate.

Where there is an intestacy, the person who is entitled to apply to the Court makes an application to the Court for a Grant of Letters of Administration.  The application is made by an oath and various affidavits, one of which is an affidavit exhibiting a statement of assets and liabilities.  At times a person or persons may be required to guarantee the administration of an intestate Estate.
